An investigation into allegations of sexual misconduct by a teacher at Bishops Diocesan College in Cape Town has found no wrong on the part of the school.

However, it found the teacher in the midst of the sex scandal guilty of sexual misconduct, despite the fact that she did not testify in the investigation.

In addition, no steps would be taken by the school against the teacher as she has resigned from her position.

In a statement, the prestigious private school says an independent investigation found that the school did not know about the alleged incidents.

The school said that while the teacher initially promised to cooperate with the investigation, this did not happen.

"A request by the investigators for her to attend an interview with them was later refused," according to the statement from the Principal’s office.

"Furthermore, the investigators were informed that she was not prepared to make any written comments regarding the merits of the matter."

The investigation found that she engaged in sexual misconduct with at least five pupils.

"The school is co-operating with the authorities in this regard. The school has also made the parents of the affected boys aware of their rights and responsibilities in this matter," according to the statement.

It goes on to say that no fault could be found with any of its policies relating to child abuse, pornography, or its code of ethics.

It says investigators "are satisfied that the school does have the necessary policies and procedures in place to address matters of sexual misconduct and that the school has taken all reasonable steps in this regard".
