Adam Catzavelos is expected to appear at the Randburg Magistrate Court next week.
The National Prosecuting Authority confirmed on Thursday that Catzavelos would appear in court next week Tuesday.
Catzavelos filmed himself making racist comments while on holiday in Greece last year, with the video causing an uproar after it surfaced on social media.
"Let me give you a quick weather forecast here, blue skies, amazing sea and not one k***r in sight, f*king heaven on earth. You cannot beat this," he said in the video.
He was eventually dismissed from the family business, St George's Fine Foods, which supplies steaks to restaurants across the country.
The Economic Freedom Fighters (EFF) in Gauteng laid a criminal charge against the former businessman, with the South African Human Rights Commission (SAHRC) also demanding that the matter be investigated.
At the time, the commission said it had been inundated with requests for Catzavelos to be brought to justice.
Catzavelos released a statement, apologising for his comments.
