The Democratic Alliance (DA) turned to the courts to challenge the decision, saying it was politically motivated.

The court handed down the ruling on Wednesday.

Gauteng Premier David Makhura dissolved the metro in March due to its perceived inability to provide services.

An administrator was also subsequently appointed to run the metro.

The DA’s provincial leader John Moodey has welcomed the ruling.

''What also pleases us is that the court ruled the EFF and the ANC councillors must attend and remain in all council meetings, unless of course there are legal reasons.

"Futhermore, we are also pleased that the court has ruled in our favour and that the cost of three [collapsed] councils must be paid jointly and collectively by the premier, his executives, the NEC and the ANC."

He adds that the processes to appoint a new mayor and city manager has yet to be discused by the party's federal council.
