Court to hear state capture interdict applications in November

South Africans will have to wait a little while longer until the release of outgoing Public Protector Thuli Madonsela's state capture report.

Her report into state capture has been signed and sealed, but will not be delivered this afternoon.


Cooperative Governance Minister Des Van Rooyen's court bid to interdict the release was heard in the North Gauteng High Court, but is being contested by several parties, including the DA, UDM, Cope and the EFF.


President Jacob Zuma indicated that he will apply for an urgent interdict against the release of the report yesterday. 


In his papers, Van Rooyen says he hasn't been given enough time to respond to the findings of the report, adding that the report implicates him and has adverse findings against him. 


Judge Dawie Fourie proposed that, since Van Rooyens application and relief sought is similar to that of the President's application, the matters should be heard at the same time. 


It will now be heard on 1 November.


The order goes on to say that the Public Protector's state capture report will not be released to the public and will be preserved and kept in safe keeping pending the determination of the court applications.
