Dudu Myeni accused of lying

South African Airways (SAA) board chairperson Dudu Myeni has been accused of being untruthful in her submissions to the Companies Tribunal.

The tribunal is probing whether Myeni, in her capacity as director of the SAA board, acted in a delinquent manner.


The hearing dealt with claims that she misrepresented a board decision to former Public Enterprises Minister Malusi Gigaba relating to a lucrative aircraft deal in 2013.


Myeni's lawyer, Francois van Zyl, says they want the tribunal to declare Myeni's compliance notice unlawful.


He says Myeni telling Gigaba that the board was leasing two aircrafts - and not 10 - was not a lie, but a mistake on her part.


"Clearly what she said to the minister was wrong. We say that she was under that impression. The respondent finds that they are unsure whether she acted innocently or intentionally. We say there is room for confusion," says Van Zyl.


Companies and Intellectual Property Commission lawyer Robin Pearse says Myeni should have submitted a proper explanation of what transpired.


"Whether Ms Myeni regards it as compensating errors or something of the sort, the commission is deeply disturbed and believes both these communications were untruthful and misleading," says Pearse.
