Dudu Myeni skips court appearance, cites ‘medical condition’

Former South African Airways (SAA) CEO Dudu Myeni failed to appear in court on Wednesday in connection with the outing of a witness during the commission of inquiry into state capture.

Myeni was expected to appear before the Johannesburg Magistrate’s Court.

Her legal team told the court that Myeni suffers from a medical condition that prevented her from travelling to court.

The NPA’s Phindi Mjonondwane says a warrant has been issued but will be stayed until her next court appearance on 14 June.

"The office of the DPP has decided that prosecution against Dudu Myeni should proceed, as the National Prosecuting Authority is convinced she has a case to answer against the allegation that she deliberately disobeyed the order made by the chairperson of the Commission into State Capture allegations.'

During her appearance at the Zondo commission in 2020, Myeni mentioned the name of the witness four successive times.

This is despite chairperson Raymond Zondo's order that the witness should be referred to as ‘Mr X’.

Mjonondwane says the State is eager to proceed with the trial.

"This is a clear indication that the NPA will act fearlessly and independently in holding those responsible for alleged transgressions to account.

"The State is quite eager to proceed with this trial and such delays, whether inadvertent or genuine, cause unreasonable delays in the course of justice, especially in state capture related cases where there is utmost urgency to see justice served."
