Duduzane Zuma seeks to have charge dropped

The legal team representing Duduzane Zuma has asked the Randburg Magistrates Court to discharge the charges of culpable homicide due to insufficient evidence.
Former president Jacob Zuma’s son appeared in court on Wednesday for day two of his trial.
The state formally withdrew one of two charges of culpable homicide against Duduzane on Tuesday.
He pleaded not guilty to a charge of culpable homicide which resulted in the death of Phumzile Dube in a crash between his luxury Porsche and a taxi in 2014.

The state withdrew the charge relating to Mashaba after it was found that her death was due to a pre-existing condition.
Zuma's lawyer, Mike Helens, told the court that his client wasn't negligent when his Porsche crashed into a taxi.
"What negligence on the part of Mr Zuma was proved? Facts, none. They proved a collision, they proved a rainy night, they proved a dark rainy night."
Hellen said a fault on the car could have led to the accident.
"There is no suggestion to the contrary that unbeknown to anyone that this Porsche 911 Turbo is a vehicle prone to aquaplaning (slide uncontrollably on a wet surface) and they had to modify the vehicle to stop these unexpected events. All of the evidence suggests something extraordinary happened."
Hellens believes the state failed to provide evidence to indicate culpability on the part of Duduzane.
The case was postponed to Friday.
