Energy minister won't appeal judgment blocking nuclear deal

Energy minister Mmamaloko Kubayi will not appeal the Western Cape High Court judgment on the nuclear energy deal.

After much opposition and controversy surrounding the matter the court declared the deal was invalid.



Kubayi says the judgment raised some concerns, not only for them, but for the five other countries - including Russia and China.



She doesn't believe they have let the country down.



"The fact that we are accepting the judgment does not mean we are agreeing with everything about the judgment. I think that needs to be clear," Kubayi stresses. 



She says the department accepts there are things they could have done better. 



"But we think the judgment has gone beyond what it should have. In certain aspects, it was as if the judgment was based on public opinion and not the law."



The minister said they are not in a position to give timeframes for the project, but South Africans need to know that nuclear has to be part of our future.



"Whether we do nuclear today or tomorrow, there is a need for nuclear in the country because of its ability in helping us meeting our obligations of 2020 of reducing carbon emission by 34%," Kubayi explains.
