Former Eskom CEO Matshela Koko has told the commission of inquiry into state capture that the real capture of power utility was done by mining company Glencore.

Koko appeared before the commission on Thursday.

He has been implicated by several witnesses in colluding with the Guptas to loot Eskom, which in turn has led to the power utility’s financial woes.

But Koko says the National Prosecuting Authority (NPA) and the commission investigators have set their eyes on innocent individuals and are not following the evidence.

Koko said according to his knowledge, evidence shows that Glencore, which had partnered with President Cyril Ramaphosa's company Shanduka, did the capturing.

"When Glencore bought Optimum Coal, mine they had an ace up their sleeve which was the political connectivity of the current head of state. This is why you cannot explain why Glencore did not pay Eskom R1.5 billion it owed.

"Glencore owed Eskom penalties of R1.5 billion rand and never paid. There is no reason why it was never paid and it was due to Eskom. When it became unreasonable and unpalatable to continue not to pay Eskom, in 2014 they concocted the famous cooperation agreement which I argue is unlawful. Your investigators are not asking what was relied on to draft this agreement," said Koko.

He said the allegations that he and others helped capture Eskom are linked to their attempts to deal with Glencore's capture of the power utility.
