Gordhan files papers to interdict Mkhwebane report

Public Enterprises Minister Pravin Gordhan has lodged an
urgent application in the North Gauteng High Court in Pretoria on Wednesday to
interdict remedial actions in a report by Public Protector Busisiwe Mkhwebane.
Mkhwebane released her report - "Report on an investigation into allegations of violation of the Executive Ethics Code by MrPravin Gordhan, MP as well as allegations of maladministration, corruption and improper conduct by the South African Revenue Services" on Friday.
Mkhwebane revealed in her report that Gordhan was aware of the establishment of an intelligence unit at SARS that conducted covert activities in violation of the Constitution.
She recommended President Cyril Ramaphosa institute a disciplinary process against Gordhan within 30 days and for National Assembly Speaker Thandi Modise to refer the report to the Joint Committee on Ethics and Members.
However, Gordhan wants the court to suspend the enforcement of the remedial orders by Mkhwebane and review her report.
In a statement, the Gordhan says the report ignores facts and their significance to reach its findings regarding the establishment of the SARS investigative unit.
"The Public Protector misapplies the provisions of the Constitution and applicable legislation when making adverse findings."
