Gupta brothers' extradition will take time - legal expert

There is still a long way to go before Gupta brothers Rajesh and Atul make an appearance in a South African courtroom, a legal expert says.

Criminal law expert Ulrich Roux has been commenting on the arrest of the Gupta brothers in Dubai on Monday.


The arrests come soon after the release of the first four reports of the commission of inquiry into state capture, which fingered the two in the massive plundering of state institutions during former president Jacob Zuma's time as head of state.


Roux says extradition applications are normally a long process.


"Now that they are in a custody in Dubai they would have to be an extradition application launched by our authorities in an attempt to extradite them to South Africa to face the charges in court. That process must first unfold.


"They will be entitled to bring an application for bail pending the extradition and will see if the Dubai court grants them bail because they are a flight risk.


"We will have to wait and see how far the extradition application is from the South African authorities. I think it would be very optimistic to think it will happen by next week, it does take some time," says Roux.


Their arrests come almost a year after Interpol issued a red notice in connection with the R25 million Nulane Investment fraud and money laundering case.
