High Court clears Danny Msiza of VBS ‘kingpin’ claims

The High Court in Pretoria has ruled that findings made by Advocate Terry Motau in his VBS Great Bank Heist report against Limpopo ANC Treasurer Daniel Msiza are unconstitutional and unlawful.

The court ruled on Tuesday that Motau failed to afford Msiza the right to procedural fairness before he released the report on VBS. 

On Tuesday, the court set aside claims that Msiza is one of the masterminds in the scandal that saw the looting of nearly R2 billion from the now defunct Limpopo-based bank. 

Msiza welcomed the court’s decision to clear his name. 

“I am truly humbled and elated with the judgment. It confirms on the one hand the supremacy of the Constitution and equally the independence of our judiciary, but it equally affirms our rights as South Africans.”

The money will go towards a structure created by the National Director of Public Prosecutions (NDPP) Shamila Batohi, where the public will be able to lodge complaints about any allegation of improper conduct involving NPA staff.

The 2018 report fingered more than 50 people in the looting – including several high-ranking officials and their family members. 

“It’s a confirmation of what I’ve said from the very onset when the report was issued, that I’m innocent and indeed the independent judiciary has pronounced and affirmed my innocence,” he says.  

Earlier this year the ANC confirmed that its national executive committee (NEC) had decided to reinstate two top Limpopo party officials implicated in the looting of VBS Mutual Bank. 

The NEC reinstated Msiza and former Vhembe municipality mayor Florence Radzilani due to a lack of criminal charges against them.
