High Court sets aside decision to rewrite leaked exam papers
Updated | By Karabo Tebele
The High Court in Pretoria has set aside the decision by Basic Education Minister Angie Motshekga that all matric pupils must rewrite the two leaked exam papers.
Judge Norman Davis said on Friday that the decision to rewrite was irregular, unlawful, must be reviewed and set aside
Lobby group AfriForum and the South African Democratic Teachers Union (Sadtu) took the department to court, following the announcement that Maths Paper 2 and Physical Science paper 2 will be rewritten next week.
AfriForum has welcomed the ruling and called on the department to act against the implicated pupils.
“AfriForum is very happy with the decision made by Judge Davis. We feel this is a victory not only for the four hundred thousand matrics who acted honestly and wrote their exam papers, it's also a victory over the department’s one-sided arbitrary decision in the first place,” says spokesperson Natasha Venter.
“So now we want the department to focus on catching the guilty parties to ensure the integrity of exams are above board. We are very satisfied with the judgment.”
