How authorities can get to Ajay Gupta

There has been widespread speculation as to how law enforcement agencies can get Ajay Gupta back in South Africa, or if that would even be possible.

Gupta has been declared a fugutive, and authorities have launched a manhunt.


South Africa has an extradition treaty in place with India - where the Guptas are originally from.


However getting Gupta back to the country will not be an easy task.


The OR Tambo International Airport last week confirmed he left the country for Dubai in early February


South Africa currently does not have an extradition agreement in place with the United Arab Emirates.

This amid reports that he was spotted at a wedding in India at the weekend - a country with which SA does have an extradition agreement.


Ilyayambwa Mwanawina, an international law expert, says however an agreement between two countries does not automatically mean Gupta will be extradited.


Mwanawina says his return to South Africa will depend on whether the offence that was committed in South Africa exists in India or if it is punishable by at least a year behind bars.


Mwanawina says all communications have to be done through diplomatic channels and the timeline to get Gupta back cannot be determined.
