I didn't abuse my power, Mngoma abused me, Gigaba tells Zondo commission

Former Minister of Public Enterprises, Malusi Gigaba has denied abusing his power as a former member of Cabinet to get his estranged wife unlawfully arrested by the Hawks.

Gigaba was back at the State Capture Commission of Inquiry on Friday. 


Mngoma was arrested last year following an allegation that she damaged a Mercedes-Benz G Wagon at their residence. 


Pretoria judge, Cassim Sardiwalla ruled that the Hawks abused their powers and position to avenge a domestic spat between the couple. 


Gigaba has told the commission he was not involved in her arrest.


"I gave no instructions of what must be extracted from Mngoma's gadgets or how that would have assisted the investigation on the conspiracy to kill me," he told the commission.

He also rubbished Sardiwalla's judgment, stating that it was biased and contained untruths about him based on Mngoma's testimony.


"It is unfortunate that I was not invited as a party in this case to state my side of the story,” he said.


“The judge relied on the version of the accused without inviting me. I found it peculiar, and I am still puzzled by it because the chronology of events as the judge paints them here is obviously not true and relies on a version of a falsification that was presented to the judge and not challenged." 


"I dispute the allegation that there were patriarchal motives and an attempt to abuse women's rights. In this case, I am the one who was abused, and I did nothing else but report the matter to the police," said Gigaba


He told the commission the Hawks said they have jurisdiction to investigate the case and insisted on doing so.
