Jiba, Mrwebi return as advocates

The Supreme Court of Appeal (SCA) has overturned a ruling that struck prosecuting heavyweights Nomgcobo Jiba and Lawrence Mrwebi off the roll of advocates.

Jiba and Mrwebi's titles as advocates have been restored.
Justice Connie Mocumie upheld their appeal in Bloemfontein on Tuesday.
According to the ruling, the Deputy National Director of Public Prosecutions, Jiba, and the Specialised Commercial Crime Unit head, Mrwebi, can effectively return to their jobs.
They were placed on special leave pending the outcome of this judgement.

In 2016, the High Court ruled in favour with the General Council of the Bar when it found that they were "not fit and proper" to hold the titles.
"[T]he application for the striking off the role of Ms Jiba and Mr Mrwebi is dismissed with no order as to costs. However, Mr. Mrwebi is suspended as an advocate for a period of 6 months from the date of this order, 15 September 2016."
The case relates to their decision to withdraw charges of fraud, corruption and murder against former police crime intelligence head Richard Mdluli.
"Due to the fact that there was no personal gain from Mrwebi's conduct and the fact that the purpose of such proceedings is to uphold the rules regulating the profession and not to punish the wrongdoer - the section handed down by the High Court was not justified," Mocumie found.
