Koko mulls action against state capture commission over findings

Former Eskom CEO Matshela Koko says he won’t take the state capture commission findings against him lying down.

This after the commission named Koko as one of the masterminds behind Eskom’s demise.

Eskom executives Brian Molefe and Anoj Singh were also implicated, with the commission recommending further investigations into Koko and Singh for their role in Eskom’s deal with McKinsey and Gupta-linked Trillian.

Koko still denies having anything do with fraud and corruption at Eskom.

In a bid to clear his name, Koko announced on Monday that he would challenge the findings.

“There are two options - one option is to challenge the report and the second option is to wait for the NPA [National Prosecuting Authority] to bring it on.

“I am considering both those options. I have not discussed with my lawyers, it’s been a long holiday but when my legal team come together after reading the report, I will table those options before them.”

Koko hopes it won’t be years before the matter is finalised.

“I hope the NPA’s processes go quicker because I don’t want to be caught up in two court cases on a similar matter,” Koko added.

While it’s unclear yet which of the options Koko will go for, he is not the first top official to challenge the commission’s findings.

In March, former ANC secretary-general Gwede Mantashe also announced plans to take the third instalment of the Zondo commission report on judicial review after it labelled Mantashe, now Minister of Mineral Resources and Energy, as a ‘brilliant connection’ between Bosasa and the ANC-led government.

There is one pending report by the commission.

The fifth and final report is expected is less than 6 weeks.
