Labour court dismisses Solidarity bid on Employment Equity

The Labour Court says Employment Equity legislation remains within the confines of the Constitution following a challenge by trade union Solidarity.
Solidarity sought to declare Section 42 of the Employment Equity Act unconstitutional on the basis of a report published by the South African Human Rights Commission.
The commission’s report suggested the current employment act promoted discrimination in the workplace.
Department of Labour's chief director for Collective Bargaining, Thembinkosi Nkalipi confirmed the Labour Court dismissed Solidarity's application on Tuesday.
