Lamola wants ‘justice to be seen to be done’ in Nair corruption case

Justice Minister Ronald Lamola says Pretoria Chief Magistrate Desmond Nair must be treated the same as any other suspect.

Nair appeared in the Pretoria Specialised Commercial Crimes Court on Monday on charges of corruption.


He stands accused of accepting security upgrades worth R200 000 from the now-defunct security management company Bosasa for his home in Silverton, north of Pretoria.


“In addition to the criminal charges, misconduct proceedings, as provided for in the Magistrates Act, 1993 and the Code of Judicial Conduct for Magistrates, have been instituted against Mr Nair,” Lamola said in a statement on Monday.


“There are two stages to misconduct proceedings. There is, firstly, an internal investigation conducted by the Magistrates Commission. Thereafter, there is a parliamentary procedure.”

Nair is currently on suspension.


The misconduct proceedings instituted by the Magistrates Commission have also begun. 


“All persons are equal before the law, whether they are lay persons or officers of the court,” Lamola continued.


“The law must now take its course, as it would in every criminal case. Justice must not only be done, but manifestly be seen to be done.”
