Mabuyane wins court bid against SIU’s Fort Hare probe

Eastern Cape Premier Oscar Mabuyane has won his case interdicting the Special Investigating Unit (SIU) from investigating the qualifications he obtained at the University of Fort Hare.
Mabuyane approached the Eastern Cape High Court in Bhisho to stop the SIU from enforcing a proclamation signed by President Cyril Ramaphosa in August last year, authorising them to investigate allegations of corruption and maladministration in the awarding of Honours degrees, mismanagement of funds and sourcing of public servants for study at UFH.
Mabuyane is accused of being registered for a Master’s degree without completing his Honours.
But he has since argued that he obtained his qualification through legitimate means.
Judge Thandi Norman delivered the judgment on Tuesday.
"In the circumstances, I grant the following order, the Special Investigating Unit is interdicted from enforcing Proclamation 84 of 2022 published in the government gazette on 5 August 2022 insofar as the SIU has taken steps or intends to take steps that are directed at the applicant."
Norman added that all respondents are to bear their own costs.
In Part B of the application, which is still pending, Mabuyane wants the proclamation to be declared unlawful and invalid.
