Arguments were heard yesterday in his appeal against the decision not to grant him bail.

Judge Ratha Mokgoathleng says the original decision to refuse bail was not lawful.

"The appellant is submitted to bail which is fixed in the amount of R2000. He is entitled to participate in any lawful activity on campus. Because you are facing charges of public violence, you are to desist from participating in unlawful activities which are intended to disrupt academic activities of the university," says Mokgoathleng.

Dlamini faces five charges that include malicious damage to property, theft and assault after he was arrested during violent protests at Wits, amid calls for free higher education.

He is expected back in court on 15 November.
