Criminal charges laid against Mkhwebane

Perjury and defeating the ends of justice charges have been laid against Public Protector Busisiwe Mkhwebane.

Public litigation institute Accountability Now director Advocate Paul Hoffman believes the charges will be the straw that ultimately breaks the camel’s back.

Mkhwebane is facing at least three judicial reviews of her remedial action, a probe to have her struck off the roll of advocates, an inquiry by Parliament into her fitness to hold office – and now criminal charges.


“I’ve suggested to her long ago that she steps down and seems determine not to,” said Hoffman.

Organisation Accountability Now has laid perjury and defeating the ends of justice charges against Mkhwebane.

The charges stem from the Constitutional Court judgment over the so-called Absa/Bankorp matter.


The court ruled that Mkhwebane acted in bad faith and was subsequently slapped with a personal cost order.


Hoffman said that he had also laid a complaint at the Chapter 9 institution - asking that she be investigated for maladministration of her office.
