Ndimande brothers granted leave to appeal extradition

The Mbabane High Court in eSwatini has granted Siyabonga and Malusi Ndimande an opportunity to appeal their extradition application to South Africa.
This was confirmed by Magistrate Vincent Hlatswayo in Durban on Friday.
In August, the Manzini Magistrate’s Court granted the extradition of the Ndimande brothers.
The two brothers were arrested at a rented house in Mbabane earlier this year.
They are accused of the murder of rapper Kiernan 'AKA' Forbes and his chef friend Tebello 'Tibz' Motsoane in Durban last February.
Hlatswayo warned that he would not entertain any further postponements in the matter.
"It would be in the interest of justice and convenience that the accused who allegedly committed an offence together be tried together, but if that is not possible, hard luck.
"Moreover, on the last appearance when the matter was postponed until today, the state placed on record that whether these accused are available or not, the state will be able to proceed with the case against the accused before the court.
"I'm not going to grant an application for postponement for the outstanding accused, but to me, what has been said about the compilation of the indictment and copies of the docket and so on makes sense, sitting with the bail application notes, I had about four arch files with the bail application notes.
"I am therefore inclined, and I'm granting the application for postponement to prepare the indictment and copies for the defence. I will ask you, gentlemen, to agree on the date when the matter can be postponed for indictments and indictments only."
The matter has been postponed to 7 February.
