Parly postpones Jiba, Mrwebi matter pending interdict application

Parliament’s select committee on justice has postponed its deliberation of the dismissal of former deputy prosecutions boss Nomgcobo Jiba and fellow former top prosecutor Lawrence Mrwebi from the NPA pending Jiba's urgent interdict application.

Jiba filed an urgent interdict which will be heard in the Western Cape High Court on Wednesday.

The committee was due to start deliberating on the futures of Jiba and Mrwebi on Tuesday.

In June, the Constitutional Court dismissed an application by the General Council of the Bar to have Jiba and Mrwebi struck off the roll of advocates.

 

In April, the pair were axed from the National Prosecuting Authority (NPA) by President Cyril Ramaphosa, following a recommendation by the Mokgoro Inquiry into their fitness to hold office.

 

The high court in Pretoria had ruled in favour of the bar to have Jiba and Mrwebi struck off the roll of advocates for their conduct in several prosecutions which failed during their time at the NPA, including the fraud and perjury case against former crime intelligence head Richard Mdluli.

Parliamentary legal advisor Siviwe Njikela said they will not be opposing Jiba's application, but will submit a notice to abide by the court's decision accompanied by an explanatory affidavit on its statutory obligation to finalise the matter.

 

Njikela added that it would make very little sense to start a process which could be stopped the next day.

 

"In terms of the rules, there is a specific rule that deals with a matter that is pending before the court.

 

"On that basis our view is given that it is an urgent application - in our view there will be nothing wrong in Parliament saying let's hear what happens tomorrow. If they get an interdict but if the committee decides otherwise you may start a process today that will be stopped tomorrow I don't see how that helps the committee or anybody else."
