Solidarity threatens to drag Eskom to court

Trade union Solidarity is threatening to drag Eskom court to force it to answer questions around corruption and mismanagement at the power utility.

This could see former Eskom CEO Brian Molefe and other executives being held to account for what Solidarity has dubbed “self-enrichment”.
The union’s CEO Dirk Hermann briefed the media in Centurion on Wednesday.
Hermann said Section 165 of the Companies Act compels entities to investigate and rectify wrongdoings through the civil law actions and criminal prosecutions.
“The steps taken against Denel form part of a much larger campaign, Solidarity’s legal tax protest. We plan a similar Section 165 application against Eskom and we hope the action will still be the same.”
Solidarity has also started with a similar process against state-owned arms manufacturer Denel.

“Solidarity has, among other things, prepared a Denel dossier containing alleged wrongdoings and corruption which was also handed to Denel,” added Hermann.
