Soshanguve New Year’s Day shooting: Case against 4 accused postponed

The case against four suspects linked to the New Year’s Day shooting in Soshanguve has been postponed to 30 January for formal bail application.

Four suspects appeared before the Soshanguve Magistrate Court on Friday morning, including Sizwe Msibi, whose case was struck off the roll on Tuesday.

Defence lawyer Stevens Magoro told the court he intends to challenge how Msibi was rearrested.

He further stated that he’d not seen the J50 form used to secure Msibi’s appearance before the court on Friday.

Meanwhile, George Nyathi, who was absent from court on Tuesday, stood in the dock with visible lacerations on his face and head.

It emerged in court on Tuesday that Nyathi had been booked out of the cells at around 8 pm the night before. 

It was confirmed that Nyathi had been hospitalised after proceedings had to be adjourned for the state to establish his whereabouts.

Magoro said both Nyathi and Msibi informed him that the police assaulted them.

Msibi had first appeared dressed in a white vest with blood stains.

The pair joined Sipho Kgomo and Tshepo Mosemeni, who were arrested earlier this month.

All four remain in custody at the Kgosi Mampuru Correctional Centre in Tshwane.

At the same time, in a statement, the Hawks confirmed that a fifth suspect was also due to appear before the Pretoria North Magistrate Court on Friday on a charge of being in possession of an unlicensed firearm.

A sixth person, a woman, was released after she could not be linked to the crime.
