The North West High Court has barred delegates from the African National Congress' (ANC) Bojanala region in North West from attending the party's national elective conference at the weekend.
The court set aside the Bojanala regional conference and 40 branch general meetings.
The court found the branch meetings to have been unconstitutional, nullifying all its elected branch executives and voting delegates.
Judge Monica Leeuw ordered that they be prohibited from attending the party conference in Nasrec, where the ANC will be electing new leadership.
''All the branch general meetings inclusive of its decisions, resolutions and elections held during October to November 2017 for the purpose of electing delegates to the National Conference are irregular, invalid and unconstitutional and therefore set aside.’’
In reaction ANC secretary general Gwede Mantashe said they will appeal the judgement.
''You can't give a judgement on a conference and ban ANC members from participating in their political party which they are voluntarily joining, we think on that one, the judges have misled us.
''Banning any ANC members from participating in other activities is actually judicial overreach, we will not accept it, we will appeal it.''
Former Bojanala regional secretary Tokyo Mataboge and 39 others approached the court seeking an order to set aside the branch general meeting of 40 branches and nullify the Bojanala regional conference of 24 September 2017.
