Captain Justice Dladla, 42, reportedly shot dead the robber after he had opened fire at a Kentucky Fried Chicken in New Germany in Durban in October 2012.

One of his colleagues was killed in the incident while another was critically injured.

The Independent Police Investigative Directorate (Ipid) laid charges of murder and defeating the ends of justice against the police official.

Spokesman for the Ipid Moses Dlamini said: "At the time, it was reported that the (robber) was shooting at the police captain. An investigation was conducted and it has revealed that this version was false."

Dladla's lawyer Sifiso Sithole told the court the shooting took place while his client was on duty.

He said his client intended on pleading not guilty to the charges brought against him.

"The State does not have a case against the accused," said Sithole.

The officer, who is a father of five, was out on a warning.
