Court hears Magudumana ‘did not delay any investigations'

Dr Nandipha Magudumana’s legal representative Machini Motloung told the Bloemfontein Magistrate’s Court on Monday that his client did not delay any investigations into the case against her.

"The applicant didn't play any role in the delays in the finalisation or conclusion of the investigation. The case is still pending, and investigations have not yet been completed. We do not have an indication of how far the investigations will go.


"On the 11 of October 2023, the state would have concluded the investigations, which would have to then deal with the trial and pre-trail issues which will take a while."


Motloung was delivering his closing arguments in Magudumana’s second application for bail.


Magudumana appeared in the Bloemfontein Magistrate's Court on Tuesday for closing arguments in her bail application.


She is accused of helping convicted rapist and killer Thabo Bester escape prison in May 2022.


Motloung told the court that Magudumana would only be able to afford R10 000 for bail.


"We are of the view that the amount of R10 000 is an amount that would be fair under the circumstances that any amount higher than the one proposed would be tantamount to a refusal of bail, that she is a correct candidate to be admitted to bail and that bail in the amount of R10 000 should be fixed."


However, state prosecutor Sello Matlhoko told the court that Magudumana had not taken the court into confidence.


"...And yet we are told that the investigating officer is not giving evidence, he is not getting into the charges, and that's what the applicant does. We don't know where she got kidnapped and where."


The case continues.
