Dalindyebo did not breach parole conditions, claims royal advisor

AbaThembu King Buyelekhaya Dalindyebo has not breached the conditions for his presidential parole, according to royal advisor Matthew Mpahlwa.

Dalindyebo was arrested on Friday morning on charges of assault and malicious damage to property.

He is expected to appear at the Mthatha Magistrates' Court on Friday following his arrest.

The details around what led to his arrest are still sketchy, but it's understood that the beleaguered king arrived at the Bumbane Great Place in the Eastern Cape in the early hours of the morning.

But his return to the royal palace was met with resistance.

"He left East London Westbank prison (in December) and returned to his father’s residence in Mthatha, which is called eNkululekweni, which is closer to town and not at the rural homestead or the royal palace eBumbane village," Mpahlwa explains.

"It is only in the early hours of the morning that the Queen (Nokwanda) said that the King wanted to go to his home."

Mpahlwa says a 55-year-old then alerted law enforcement of the unwelcome visit.

"We find it strange that him as being the head of the family and the head of the homestead that is house and if you desire to return to your home at whatever hour that you decide on and then there is a charge of damage to property, whose property? " Mpahlwa asks.

It's unclear what damage was caused during the altercation but Mpahlwa adds that this run in with the law is not cause for the King's parole to be revoked.

"The fact that someone is arrested and is appearing in court does not ipso facto lead to a conclusion that he is in breach of parole condition.

"The fact that police are investigating a criminal case again does not again ipso facto necessitate a revocation of a parole," Mpahlwa adds.

The Community Corrections, under the Department of Correctional Services, is yet to investigate whether or not Dalindyebo breached his parole conditions.

The 55-year-old was serving parole after qualifying for a remission of his 12-year sentence announced by President Cyril Ramaphosa last year.

He had been convicted for assault with the intent to do grievous bodily harm, kidnapping, defeating the ends of justice and arson.
