Dlamini to continue fight to have charges withdrawn

Fees Must Fall leader Mcebo Dlamini's legal team has confirmed they will make an application to have the charges against him dropped.

They believe the charges to be politically motivated. 


Dlamini was in court this morning to hear the reasons why he was granted bail. 


He is set to be back in court in June.


Judge Raatha Mokgoatlheng raised a number of issues with the evidence and said the decision to deny Dlamini bail was unconstitutional.


"There is not evidential basis whatsoever that the appellant has a propensity for committing public violence, malicious damage to property, theft or assault to cause grievous bodily harm. This factual conclusion by the court I quote is a total misdirection and shows the court exercised its discretion wrongly," says Judge Mokgoatlheng.


Dlamini's lawyer, Thabo Kwinana, says they want the charges to be dropped.


"We have been given the opportunity to submit an application for the charges to be withdrawn," says Kwinana.


Dlamini says he hopes this will aid other students who have been arrested.
