Jiba to challenge the Mokgoro Inquiry findings

Former prosecutions boss Nomgcobo Jiba plans to take the report by the Mokgoro Inquiry on judicial review.

The report, by retired Judge Yvonne Mokgoro, recommended that President Cyril Ramaphosa fire her and colleague Lawrence Mrwebi from the National Prosecuting Authority (NPA).


 


Her lawyer Zola Majavu made the announcement on Thursday after the Constitutional Court ruled against the General Council of the Bar, which sought to have the former top prosecutors struck off the roll of advocates.


 


"As things stand, we are pleased with the ConCourt's outcome, but my client is equally sad because what was supposed to be the end is actually the beginning of another three-year journey because we will know that she does not have the media shouting praises in her corner and she has kept a dignified silence."

The highest court in the land upheld a Supreme Court of Appeal judgment which ruled in favour of the pair, overturning a decision by the high court in Pretoria to have them removed as advocates.


 


"Once all of these processes are finalised the only places she can fight her battles is in courts of law. A review will have to be lodged in the high court, we may or may not succeed, we will then probably end up at the Supreme Court of Appeal, where we may also succeed or not succeed and then we are back here in Braamfontein. That is also another three-year journey."


 


Majavu says despite the scathing findings by the Mokgoro Inquiry, Jiba feels she has been targeted because she is a black woman.


 


He was not clear on whether she will continue to fight in order to return to the NPA, but said she is entitled to ventilate and protect her rights through the rule of law.
