Maile confident SCA will overturn Tshwane ruling

Gauteng MEC for Cooperative Governance and Traditional Affairs Lebogang Maile says he is confident that the Supreme Court of Appeal will rule in the provincial government’s favour.

The Gauteng government has lodged an urgent appeal against a high court ruling which brought to an end the administration process in Tshwane.

 

The High Court in Pretoria on Wednesday ruled in favour of the Democratic Alliance's (DA) application to have the court judgment – declaring the dissolution of the Tshwane council illegal – implemented immediately.

 

The DA had planned to hold a council meeting to elect a mayor on Friday but had to postpone due to application to appeal.

The party's Randall Williams says the party will be requesting the SCA to urgently set a date to deal with the matter.

 

"The Democratic Alliance’s legal council will be writing to the Supreme Court of Appeal to ask that the court urgently sets a date to deal with the ridiculous appeal that has been submitted by the Gauteng MEC of Cooperative Governance, Lebogang Maile.”

 

Meanwhile, Maile says he strongly disagrees with the high court ruling.

 

"We actually don't understand how the court came to a different conclusion in this matter because the administrators are doing well, the situation is stabilised, service delivery is proving [good].

 

"Bringing back the mess that was there whilst waiting for the appeal is not in the best interest of the citizens of Tshwane.

 

Maile says he believes the case is likely to be heard very soon.
