Maile confirms Gauteng govt will not appeal SCA’s Tshwane ruling

Gauteng Cooperative Governance and Traditional Affairs MEC Lebogang Maile says the provincial government will not appeal the ruling on Tshwane by the Supreme Court of Appeal in Bloemfontein.

The city’s council election the Democratic Alliance’s (DA) Randall Williams as the city’s new mayor on Friday.

 

Williams’ victory came after the SCA ruled in favour of the DA and found that the decision by provincial government to dissolve the council was unlawful.

 

Maile and Premier David Makhura announced in March that the executive council in the province would appoint administrators to run the city’s affairs.

Maile welcomed William's appointment, urging him to work with the provincial government.

 

"I spoke to him on Saturday told him from the government point of view that we will work with them. We congratulate him and wish all the best.

 

"We urge to work with us and not against us, but I don't think he would work against us he knows we are brutal," Maile said.

 

Maile said they won’t challenge the decision because there is already a separate matter at the Constitutional Court.

 

"If the Constitutional Court finds in favour of the Exco, the SCA judgment will be short-lived. Exco further noted that the SCA judgment is highly appealable in the Constitutional Court, but has decided not to do so.

 

“We are not appealing because we think we won’t win. But remember there is a case at the Constitutional Court," he explained.

 

In compliance with the ruling, the provincial government has withdrawn the administrators in Tshwane with immediate effect.
