The summons was delivered shortly after Malema and the EFF addressed the media at their headquarters in Braamfontein.

Malema has been summoned to appear in court in November in connection with comments he made on land reform in December 2014.

EFF Deputy President, Floyd Shivambu said they believe the charge is connected to the Public Protector's investigation into state capture.

"It's part of the Public Protector's report on state capture, because the CIC (Malema) is part of those who have made submissions about the incidents of state capture by the Gupta family," Shivambu said.

Malema said the party has given evidence to outgoing Public Protector Thuli Madonsela, as part of her probe into state capture.

Malema warned incoming Public Protector Busisiwe Mkhwebane to ensure that the issue of state capture remains a top priority.

He said it's clear that the Gupta family is pulling the strings.

Malema said the EFF will be keeping a close eye Mkhwebane to ensure she picks up where Madonsela left off.

"My sister, wherever you are, you must now that this is not your family business. This is our business called Public Protector. If you made commitments somewhere, you will now see that it is very difficult to keep those committments. You are entering an institution. Not some clownish arrangement," Malema said.
