NPA mum on reasons for resignation of ‘Malema prosecutor’

The prosecutor leading the case against Julius Malema in the Eastern Cape has resigned from the National Prosecuting Authority (NPA).

On Tuesday, Malema pleaded not guilty to five charges related to the discharging of a firearm at the party's fifth anniversary celebrations in East London. 

He is charged alongside security company director Adriaan Snyman, who faces a charge of Contravening the Firearms Control Act.

Snyman also pleaded not guilty. 

 On Wednesday, NPA provincial spokesperson Luxolo Tyali confirmed Elna Smit resigned earlier this week but would not be drawn into the reasons. 

“She did advance the reasons for resignation but we need to respect principles which are fundamental to labour relations - that you cannot go around divulging her reasons for resignation. 

“The case has been handed over to another prosecutor who is currently doing it. Yesterday the case proceeded, we called five witnesses,” Tyali said.  

He added the NPA doesn’t anticipate any further delays to the case. 

“We only requested one postponement for one day on Monday.  

“We do not foresee any further delay because that prosecutor is as competent as the one who has resigned.”
