On Friday the court dismissed the application by the NPA to overturn a previous High Court ruling that criminal charges against President Jacob Zuma be reinstated.

This after NPA boss, Shaun Abrahams, announced in April this year that they were going to appeal a high court ruling that the decision to drop over 700 corruption charges against Zuma was irrational.

Spokesperson for the NPA, Luvuyo Mfaku, says the NPA took the matter to the constitutional court because it relates to their independence.

"It was just to say they are still waiting for the SCA [Supreme Court of Appeals] to decide on the matter between the president of the republic and the SCA," he said.

"It could not be in the interest of justice to decide on our leave to appeal while the SCA needs to appeal," Mfaku said.
