Terms of reference for state capture inquiry to be revealed

The terms of reference for the judicial commission of inquiry into state capture will be published in the Government Gazette on Thursday.

The scope of the investigation has been a bone of contention, with some demanding that the commission not only probe the influence of the Gupta family on the state, but all cases of state capture.

 

Justice Minister Michael Masutha says the terms of reference will be published in the Government Gazette, but warns it could still be challenged in court. 

 

Masutha says he received the proclamation from President Jacob Zuma on Tuesday.

The Pretoria High Court dismissed Zuma's application to review and set aside former Public Protector Thuli Madonsela's State of Capture report.

 

Judge Dunstan Mlambo held that Madonsela's recommendations are binding and valid, that she had the power to instruct the president to exercise his executive authority.

 

Masutha believes says law constitutes that the terms of reference can be challenged in court.

"Anything can be challenged in court if any interested party is unhappy."

 

Masutha says dissatisfied parties are within their rights to challenge the terms of reference if they believe it not to be within the prescript of law.
