A 39-year-old suspect made his third appearance in the Bishop Lavis Magistrate’s Court on Friday in connection with the apparent hit.

Kinnear, who was an Anti-Gang Unit section commander, was gunned down in his car in front of his home in September.

The National Prosecuting Authority (NPA) says the suspect, Zain Killian, will remain behind bars.

“You’ll remember that last week the matter had to be postponed because there was an issue with security risk around this court. After that we made calls to the Judge President of the Regional Court requesting that the matter be transferred to one of the regional courts,” says the NPA’s regional spokesperson, Eric Ntabazalila.

“Up to now we haven’t received a response from the Judge President of the Regional Court. We hope by next week 14th when we come back we have a date and a new court the bail application will be heard,” he adds.

The suspect’s defence attorney, Eric Breyer says he’s not happy about the delays.

“The defence is very disappointed with the state because from the very first appearance here, which was 17 days ago, the state undertook to find an alternate court so that we could hear the bail application as expeditiously as possible,” says Breyer.

Breyer adds: “We haven’t been appointed or given a regional court as yet, but hopefully by next Wednesday will be able to do so.”

The 52-year-old Kinnear investigated several high-profile cases in the Western Cape.
