NPA: Afriforum disrespecting the law

The National Prosecuting Authority (NPA) has described Afriforum's latest private prosecution case as having no basis in law.

NPA spokesperson Luvuyo Mfaku believes Afriforum's intention to institute a private prosecution application against its deputy director Nomgcobo Jiba is unconstitutional.
Mfaku says the court case not been completed and Afriforum can therefore not bring a private prosecution case.
"Freedom Under Law instituted legal proceedings in the Pretoria High Court to review and set aside the decision not to prosecute Advocate Jiba on fraud and perjury charges. The court has reserved its judgement. This process is not finalised and AfriForum cannot talk about private prosecution whilst the court's judgement is still pending."
The matter relates to charges of racketeering that Jiba instituted against former KwaZulu-Natal Hawks boss Johan Booysen.

"We can never consider that application while there is a judicial process pending relating to this matter. This is a flagrant disregard and disrespect for court process. Let's allow court processes to complete before we institute a private prosecution application."
