Solidarity to oppose Molefe appeal

Trade union Solidarity will oppose an application for leave to appeal by former Eskom CEO Brain Molefe against a judgement forcing him to pay back his pension payout.

Molefe has applied to the Supreme Court of Appeal (SCA) for leave to appeal against a North Gauteng High Court judgement, compelling him to pay back R11 million within 10 days.

 

The money was paid to Molefe when he left the power utility in 2016.

 

Solidarity's Dirk Hermann is adamant that the payout was unlawful.

"We are absolutely astonished with the fact that Mr. Molefe wants leave to appeal. The fact of the matter is that he must be ashamed, he must asked South Africa for forgiveness and pay the money back."

 

Molefe believes the High Court failed to grasp his employment status at the power utility.

"The minister's evidence was not as found by the full court to the effect that she had always understood that Mr. Molefe had resigned. To the contrary, the Minister's first affidavit before the court made it clear that the Minister accepted that Mr. Molefe had not resigned unilaterally," he says in court documents.
